Retirement Age of Doctors: Amendment inwards Fundamental Rules 56

NOTIFICATION

New Delhi, the 11th August, 2018

G.S.R. 767(E).—In practise of the powers conferred yesteryear the proviso to article 309 of the Constitution, the President hereby makes the next rules farther to ameliorate the Fundamental Rules, 1922, namely :-

1. Short championship too commencement.—(1)These rules may last called the Fundamental (Second Amendment) Rules, 2018.

(2) They shall come upwards into forcefulness on the engagement of their publication inwards the Official Gazette.

2. In the Fundamental Rules, 1922, inwards dominion 56, for clause (bb), the next shall last substituted, namely:- “(bb) (i) The historic menstruation of superannuation inwards abide by of the doctors belonging to–

(i) Central Health Service;

(ii) Indian Railways Medical Service;

(iii) AYUSH too working nether the Ministry of AYUSH;

(iv) Civilian doctors nether the Directorate General of Armed Forces Medical Service;

(v) Medical Officers of the Indian Ordnance Factories Health Service;

(vi) Dental Doctors nether the Department of Health too Family Welfare;

(vii) Dental doctors nether the Ministry of Railways; and

(viii) General Duty Medical Officers, Specialist Grade doctors too Teaching Medical Faculty working inwards Bhopal Memorial Hospital too Research Centre,

shall last sixty-two years unless they practise the option of posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes too functions including advisory too consultancy depending on their expertise too experience, equally decided yesteryear the competent authorization inwards the concerned Ministry or Department from fourth dimension to time, inwards illustration they wishing to proceed inwards their service upto the historic menstruation of sixty-five years:

Provided that the historic menstruation of superannuation inwards abide by of the doctors belonging to the General Duty Medical Officers sub-cadre of Central Armed Police Forces too Assam Rifles too Specialist Medical officers of Central Armed Police Forces too Assam Rifles shall last sixty-five years.

(ii) The serving doctors belonging to the services referred to inwards sub-clause (i) who accept either already attained the historic menstruation of sixty-two years or attaining the historic menstruation of sixty-two years inside vi months from the engagement of publication of these amendment rules inwards the Official Gazette, may practise their option inwards visit to their posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes too functions including advisory too consultancy equally specified inwards sub-clause (i), inside a menstruation of xxx days from the engagement of the get-go of the Fundamental (Second Amendment) Rules, 2018.

(iii) The serving doctors who neglect to practise the option inwards visit to their posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes too functions including advisory too consultancy equally specified inwards sub-clause (i), inside the menstruation specified inwards sub- clause (ii), shall last superannuated shape their service on attaining the historic menstruation of sixty-two years or on croak of a menstruation of xxx days from the engagement of the get-go of the Fundamental (Second Amendment) Rules, 2018, whichever is later. ”.
